Defections of 12 SDFMLAs accepted as valid mergers, given House seats with their respective parties

GANGTOK: The separate petitions of 12 SDFMLAs – 10 of whom defected to the BJP and two who switched over to ruling SKM last year – were accepted by Speaker L.B. Das on Monday during the one-day Assembly session.
The Speaker made the announcement at the outset of the Assembly session, an IPR release informs.
D.T. Lepcha, Ugen T. Gyatso, N. K. Subba, D. R.Thapa, K. S. Lepcha, K. B. Rai, Pintso N. Lepcha, T. T.Bhutia,Farwanti Tamang and Raj KumariThapa of Sikkim Democratic Front (Legislature Party) had submitted documents to the Speaker on November 22 last year stating ‘having duly comprised of 2/3rd members have merged with the BharatiyaJanata Party (Legislature Party).’
In his order, the Speaker said the petition of the 10 MLAs was found satisfactory in the interest of the established anti-defection law and thus, the merger is hereby accepted.
Similarly, Em Prasad Sharma and G.T. Dhungel had submitted documents to the Speaker on November 27 last year stating that ‘having duly comprised of 2/3rd members of the remaining Sikkim Democratic Front (Legislature Party) have opted to merge with the Sikkim Krantikari Morcha (Legislature Party)’.
In his order, the Speaker mentioned that the petition of the two members was found satisfactory in the interest of the established anti-defection law and thus, the merger is accepted.
Further the provisions of the paragraph 2 (1) (a) of the 10th Schedule of the Indian Constitution i.e. disqualification on the ground of defection if he has voluntarily given up his membership of such political party shall not be attracted upon them.
Consequent upon his decision, the 10 MLAs were allocated seats along with the other BJP members in the Assembly while the two MLAs were given seats along with the SKM members.
With this validation of the 12 defections, the SDF now has former Chief Minister and party president Pawan Chamling as the lone SDF member in the Assembly.
